TERMS AND CONDITIONS FOR THE INTEGRATION OF A SNAPPI CARD INTO A THIRD-PARTY DIGITAL WALLET
Snappi Bank (hereinafter "Snappi" or the "Bank") enables its customers (hereinafter "the Customer") - cardholders to add the cards issued by Snappi (i.e. any active prepaid or debit card legally held by the Customer in accordance with the specifications of the International Mastercard Organization) to a digital wallet (hereinafter the "Digital Wallet") owned or managed by a third-party provider (hereinafter the "Provider"). Snappi may, at its discretion, set additional criteria for the registration of the Card in the Digital Wallet. The Customer will be able to make transactions by using the Digital Wallet without being required to use the plastic Card.
The following terms govern the registration and use of the card issued by Snappi in the Digital Wallet and which the Customer shall accept in order to add the card they wish to use into the Digital Wallet:
- A prerequisite for the registration of the card into the Digital Wallet is that it shall be active and valid. Snappi, in its discretion, has the right to impose additional conditions for the registration of the Card in the Digital Wallet. Subject to the terms hereof, terms and conditions applicable to the issuance and operation of the Cards are not differentiated when the Cards are registered in the Digital Wallet. The Digital Wallet constitutes an alternative way of performing transactions by using the Card. Snappi has the right to terminate the cooperation with the Provider at any time.
- For the registration of the card in the Digital Wallet and its use by the Customer, it is first of all required that the Customer enters the Digital Wallet in the device the Customer wishes to use. Subsequently, the registration of the card is carried out through two alternative methods:
- Through the Snappi mobile app, by selecting the button "Add to Digital Wallet " and filling in the card details requested for registration.
- By entering the card details directly in the Provider's application according to the Provider's instructions for adding the card.
- By registering the cards in the Digital Wallet, the Customer consents to the transmission of their data to the Provider, irrespective of whether the registration was made through the app [Snappi mobile app] or through the Digital Wallet Provider's application directly. Such details include the Customer's full name, card details such as card number, expiry date and CVV or any other details that may be required for the registration of the card. When registering the card, the Customer may be required to take additional action for identification. In addition, security rules of the device used by the Customer may also dictate the activation of an additional security system, such as, but not limited, to Personal Identification Number (PIN), fingerprint, unlocking via facial recognition or any other similar identification mechanism.
- In case the process of card registration into the Digital Wallet is initiated but not completed, Snappi may send reminders to the Customer by any means expedient such as email, sms, viber notification, in order to complete the card registration process.
- Upon completion of the card registration process in the Digital Wallet, Snappi produces a unique "token" number for each card in each separate device registered in the Digital Wallet (i.e. the registration of the same card in more than one devices will entail the production of separate "tokens" for each device) which constitutes an identifier for the specific card, through the use of a secure encryption process of the card data. Contactless transactions as well as internet transactions in Greece or abroad can be performed through the Digital Wallet (hereinafter referred to as the "Transactions"). These options provided by the Digital Wallet may be enriched or modified depending on the capabilities of the Provider and the Bank's options without notice to the Customer. At any time, the Provider or Snappi may decide to expand, reduce or suspend the type and/or the amounts of transactions allowed through the use of the Card or change the enrollment process for registering Cards in the Digital Wallet. Similarly, a prerequisite for carrying out Transactions through the Digital Wallet is that the Customer has not imposed any restrictions on the options of using their card(s) (e.g. exclusion from the ability to carry out contactless transactions, ATM withdrawals, etc.).
- The conditions, the terms of registration and the activation and deactivation of the use of the Digital Wallet are regulated by the Provider without the participation of Snappi. The Provider, the mobile operator, the provider of the electronic device, the internet and/or internet companies, merchants and other third-party services, applications or third-party websites related to the use of the Digital Wallet are subject to their own terms and conditions and privacy policies, which the Customer is obliged to read, as acceptance of these is necessary for the use of these services. Snappi shall not be liable for any technical errors or malfunction of the Digital Wallet or for errors and delays caused by an inability to use the Digital Wallet. The features and functions of the Digital Wallet may be automatically updated or upgraded without notice.
- The Transactions are considered to be completed when the relevant indication appears in the Digital Wallet. The Customer provides an irrevocable mandate (within the scope of Art.724 par. 2 CC and remains in force pursuant to Art. 726 CC) and authorization to Snappi to settle on their behalf the amounts of the transactions carried out through the card and the Digital Wallet, by charging in the case of (a) the debit card, the account linked to it and (b) the prepaid card, the card with the corresponding amount. The Transactions are subject to the terms and restrictions provided under the card issuance and use agreement entered into between Snappi and the Customer.
- The Customer shall be informed about the Transactions carried out through the Digital Wallet by any means established and notified to Customer by Snappi in this regard.
- Snappi does not impose any additional charge or fee for the integration of the card into the Digital Wallet and its use via the Digital Wallet. With respect to charges associated with Transactions performed with the Card through the Digital Wallet, the charges set forth in Snappi's invoice will apply and the Provider’s charges, if any, will be separately referred to in the updates you will receive from the Provider. Consequently, contestation of any such Provider charges shall be directed solely at the Provider.
- The Customer shall comply with all instructions and security rules concerning their device and shall not disclose passwords or grant access or by any means allow the use of the device by third parties. In addition, the Customer shall be constantly kept updated on the information, instructions, security notifications of the device or devices that they integrate into the Digital Wallet and follow them strictly.
- As soon as the Customer becomes aware of the loss or theft of their device or that their card is debited due to a Transaction made against their will through the Digital Wallet as well as any other unauthorized use of the card, the Customer shall make all reasonable efforts to deactivate the card, remove it from the Digital Wallet and notify the Bank without delay. In case the Customer does not have access to the Digital Wallet, they are obliged to inform the Bank immediately, which shall deactivate the access to the card via the Digital Wallet. In any case, Snappi shall not be liable for any unauthorized use of the Digital Wallet and/or the Card via the Digital Wallet, nor shall Snappi be liable for any damage suffered by the Customer due to the above causes.
- Furthermore, the Bank bears no responsibility for transactions carried out by the Customer through the Digital Wallet during the period when their physical card was not yet activated, provided that they were carried out in accordance with the terms of the Provider's Digital Wallet. For debit cards, this time period applies only in the case of automatic renewal due to expiry and in the case of card replacement.
- To set up and access the digital wallet in order to carry out transactions with the card registered in the Digital Wallet, the Customer must first follow the security regulations of each device used. The Customer identification method for the use of the Digital Wallet is conducted according to the options offered by the Provider and chosen by the Customer (e.g. biometric data, fingerprint, PIN). When carrying out a transaction through the Digital Wallet, Customer identification is carried out through the device used, in accordance with the Provider's instructions and the terms and instructions for the use of the Digital Wallet, as applicable, which set out the identification requirements of each transaction without the intervention of the Bank. The use of a device, in which the Customer has registered their card in the Digital Wallet in order to carry out transactions, is equivalent to signing or entering their PIN. The use of the device in accordance with the above identifies the holder in an absolute manner.
- The Customer has the right at any time to remove the card from the Digital Wallet. In order to remove a card from the Digital Wallet, the Customer shall follow the instructions of the Provider. Snappi shall fulfill all orders relating to the Transactions executed through the Digital Wallet.
- Snappi may also, in its discretion, terminate its cooperation with the Provider. In this case, Snappi will notify the Customer of the expiry date and will fulfil all orders relating to Transactions already executed through the Digital Wallet. It also has the right to suspend the participation of the cards in the Digital Wallet for a certain or indefinite time period, informing the Customer accordingly.
- Snappi reserves the right to refuse to execute the Customer's orders for the execution of Transactions through the Digital Wallet, notifying the Customer of the reasons for its refusal, unless such notification is prohibited by the relevant Legislation.
- The Customer acknowledges and accepts that Snappi is not responsible for the delay in completing any transaction through the Digital Wallet and/or the failure to recognize the card during the transaction.
- Snappi is not contractually bound to the companies transacting with the Customer and Snappi bears no responsibility towards them or towards the Customer related to the transactional relationship between them.
- The Customer has been informed that the personal data that has been or will be lawfully received by the Bank in the future in relation to the present, will be included in the personal data file held by Snappi, in its capacity as Data Controller , and will be processed for the purpose of properly servicing, supporting and monitoring of the present transactional relationship in accordance with the Privacy Policy which is uploaded on Snappi' s website at www.snappibank.com and forms an integral part hereof.
- The laws of the state on which the Bank relies in establishing a relationship with the applicant for the Service are the laws of Greece and the language of communication between the Bank and the applicant is Greek. For out of court dispute resolution, the Customer may contact the Hellenic Financial Ombudsman orally or in writing. The agreement concluded under these terms is governed by Greek Law. For any issue not specifically regulated herein, the General Terms and Conditions of the Bank shall apply, including the terms relating to payment services pursuant to Law no. 4537/2018, which govern the general transactional relationship between the Bank and the Customer, the specific terms of each card issuance agreement, under which the card has been issued by the Bank to the Customer.
- The present constitutes a remote agreement, and its terms are in lieu of the information obligation under article 4(ix) of Law 2251/1994, as in force from time to time.
